This is true Wayne, but if a fish you catch after you have your limit (of dead fish) happens to die and cannot be released, then you're breaking the law. It would be illegal to keep it, and illegal to throw it away. The only way you can throw away a dead fish is

1...if it is out of season (incidental catch)
2...outside of a slot size

GENERAL FISHING REGULATIONS (CONTINUED)
ONTARIO’S CATCH AND RETAIN RULES
Generally, daily catch limits include all fish that are retained for any period of time and not immediately released.
Anglers fishing from a boat may catch, hold, and selectively live release more walleye, northern pike, largemouth or smallmouth bass than the daily limit, provided:
(a)
the fish are held in a livewell with a mechanical aerator operating at all times (see Anglers Guide, page 8, for livewell requirements),
(b)
the fish comply with any applicable size limits,
(c)
the Sport or Conservation Fishing Licence daily catch and retain limits for walleye or northern pike are not exceeded at any one time,
(d)
no more than six largemouth or smallmouth bass (or any combination) caught under a Sport Fishing Licence are retained at any one time, and
(e)
the Conservation Fishing Licence catch and retain limits for largemouth and smallmouth bass (or any combination) are not exceeded at any one time.
Anglers are reminded to closely monitor the condition of fish held in a livewell. Only fish that are in such a condition that they will survive may be released. Releasing a fish that will not survive and allowing the flesh of that fish to be wasted is an offence. Any fish not live-released are part of your catch limit and your possession limit.

I don't think there are any real "grey areas" it just takes a bit of reading to find everything out.

Just remember too that, Possesion limit is also 4, that technically mean you cannot physically POSSESS anymore of that species until the original 4 fish are consumed or given away. Hence out of your possession...

Other food for thought

Whats everyones thoughts on that??????

I believe "catcher" posted this earlier. Provincial law states you can have 6 walleye in your possession, as long as they were caught in 2 or more different zones.
There have been a few other posts that are quoted out of the regulation book about catch and retain limits.

Yes walleye 9, 6 walleye is the Ontario Possesion limit for 2 or more zones, so...6 is The POSSESSION limit at anyone time. The number you are allowed to have in your possession on hand, in cold storage, in transit, or anywhere.

So i have to eat or reduce the orginal six, by what ever number before I can legally Possess any more.
You can eat, then Fish then eat as long as the number In posession never exceedes 6 am i corrrect????

No, it's not like that. This was posted earlier. The catch limit states that you are only allowed to catch and keep the limit for one day, and includes fish you eat, or give away. You are not allowed to eat them, then go back for more. Possession limits is what you are allowed to have in storage. Except where otherwise specified.
I'm not saying I've never done it before, and I'm sure hundreds of other guys on here have done it also, but technically, it's against the law.
I'm not trying to be a smartass here, but these rules are in the regulation book.

Reg books are made to be read, not to just look at the pictures. There are all kinds of stipulations outside of just the charts listed in there. Did use Know in some zones you are not alloud to fish walleye on opening day near a dam till the following week????

If your catching & releasing the fish, the fish are not considered to be in your possesion even though that yes for a few min or sec you actually do posses the fish, by releasing the fish it shows your intent was not to posses the fish.

Why not just keep your first 3 and then release the rest until you plan on leaving then keep the last 1 you catch. Worst case scenario you go home one short of your limit

This is still not doing Sam any good, the poor bugger is still sitting on the ice hungry! So Joe the expert fisherman he is, sets the hook on his line and hands it to Sam who then pulls it up through the hole and ices the fish until Sam's limit is reached. They then moon the MNR's high power spotting scope and go home and stuff their faces with Quinte Gold. :lol:

You cannot continue to fish for a species once you have your limit and you are not allowed to share your fish. Once you have your limit you must stop fishing. I had an MNR guy watching two fishermen on shore in New Castle from a distance just to see if they shared fish. You can state you are trying for perch or pike but if they watch you catch many more walleye they could fine you if you don't move. Also you cannot go back out the next day if you still possess your limit from earlier this season. Be careful once you have YOUR LIMIT!!

I spoke with a MNR Enforcement Specialist from head office and pointed him at this discussion and asked for his official MNR view. He said if a guy catches and keeps his limit he CAN continue to fish as along as he immediately releases everything. In other words catch and release is clearly allowed. I asked him is it okay in this same situation where I have my 4 fish, to immediately release a fish, but snap a quick picture first. He answered "technically speaking no you cant snap a picture first as all actions must be directed at the immediate release of the fish".

Seems strange....what happens if the fish dies?? It's pretty clear in the regs that releasing a dead fish is an offence. :?
I guess there are some Grey Areas!!!
