PAL Question.
So my understanding is you need a PAL to purchase a new gun. But nothing will be registered in your name. So what stopping someone from Selling the New gun to someone else if there is no way to get back to the original purchaser ??? Hmmmmmm

The legislation is that you require a PAL to purchase any firearm, new or used. In the case of a private sale the seller is supposed verify that the purchaser has a valid PAL. As long as they do you can buy, sell and trade to your hearts content. As it should be.

If your question is what is stopping someone from selling a firearm to someone without a valid PAL, you are correct in that there is no paperwork linking the firearm to the owner. Your risk would be that if the purchaser without the PAL gets caught with it and is unable to produce a firearms licence they may inform authorities that you sold it to them in order to get some leniency. If they do and you are convicted you could lose your firearms licence, face fines, legal fees, etc.

I guess the real question is would you risk losing your firearms licence and a criminal conviction to sell a firearm to someone without a PAL. I'm not suggesting you would, but if someone did you would be relying on the hope that if the unlicenced buyer gets caught they will take the rap and keep you out of it. Not worth the risk imo, as when they get in trouble people's self preservation instincts seem to kick in and they are all too willing to throw someone else under the bus to save themselves. And they don't have a PAL why????

POL's are an interesting case. They are a firearms licence, so you are entitled to own and use firearms, just not supposed to be able to aquire new ones. They are now being phased out and new applicants can only apply for a PAL. People with a POL can submit an application to the firearms center to have it upgraded to a PAL so they can purchase additional firearms. They do an enhanced backgound check that was not required for the POL.

Now for the grey area. If a person with a POL came into posession of a new (to them) firearm by whatever means (private sale, gift, enherited) it is my personal opinion that there would actually be very little risk. The person has a licence to own a firearm, and with the removal of the registry it would be near impossible to tell when or how they aquired it. The only sticky point would be if the firearm was manufactured after the date you obtained your POL, and for some reason the authorities wanted to and are able to compel the manufacturer to tell them when the firearm was made, based on the serial number. They could then prove you aquired the firearm AFTER obtaining your POL. Not something they are likely to do unless they have a very good reason.

Personally I think they should just change all the POL's to PAL's during the next renewal and save folks the hassle of applying to get their POL changed to a PAL.
