Update on tracker law suit!!!

Hello all,

Just thought I would drop a line to give u all an update as to what's taken place over my nitro z7 cracked hull/bad tabbing/poor application of resin/too much room in bulk head.
After an almost 2 yr battle with tracker over my cracked hull amongst a few other problem that help attribute too the cracking and integrity of the hull, I am proud to announce a settlement by tracker before we actually get to a trial!!
It has been a long haul and a poor process in my opinion but this is how the process works so I am told!
In the end all I could sue for was the hull and so I did just that but with the help of a paralegal which in the end got the job done it cost me in around or just under $1500.
She was wonderful and very knowledgeable along with the enlisted help from the marine surveyor from Kingston who if anyone needs his number along with the paralegal I would be glad to bring it forth.
After a long battle of which only took prob 8-10 months with the paralegal to get to a settlement but no matter how long it was going to take I was not backing down!!
The matter is being resolved as we speak with the paralegal waiting to receive a chq from trackers law team in Toronto.
If anyone would like to know more about the case pls drop me s line as I do know a few who like me also have cracked hulls and been told the same thing, to basically go away there's no warranty here for u and so for all wondering this was not about warranty it's about how the neglected to build this boat correctly!!!!

Hey Paul I saw your name come up on the Ontario Court Date lists last week in opposition to Tracker Marine Group and I was wondering how you made out. Congrats!

Thats fantastic news. Kudos to you for seeing this through as i think alot of folks would be intimidated by the deep pockets books and lawyers of Big Coporate. WTG

Hi guys,

It's always a good day when the little guy wins for sure.
When the marine surveyor explained to me just how poorly the boat was manufactured and all the problems along with all the laws they broke I was game and the paralegal I hired was more then adequate in dealing with this case along with a little help from the surveyor!
I was quite sure it would t make it to court because of all the ramifications me winning would of had.
If I won this case in a court of law I would think they would of likely appealed it because of what it would cost going forward with a ruling against them for the construction of this and I'm sure a great deal of other vessels!!

Boy - makes one think twice before buying a Tracker Boat - I have an old '91 deep V 17 ft Tracker and can't complain - but from what I read when they went to the welded hull things went down the tubes - you would think that with the internet available to a customer who is not satisfied a company would go overboard to make sure that customers are satisfied otherwise word will get out over the net and the company will loose a lot of potential customers

Not sure many know this or maybe even remember this but I think it was 2-3 yrs ago at ferry during a windy fall day a tracker targa 18 I think it was came up wind and as they sat it down to turn around to go back with the wind as they were walleye fishing a wave came over the back as they turned and she went to the bottom!
Pretty scary thing to have your flagship boat not float?
From what I know and what I have read online u can't sink these big aluminum Lund boats!

I really don't think this is just a tracker/nitro problem from what I can gather from my marine surveyor as he said most of them have problems and most when pushed settle rather then have them spend more to loose in court.
I think that once they realize u rnt going away they make u by sending some $$ to make the problem dissapear.
Tracker started off offering me like $1,000 and lawyer said they were being very generous and too all u who know me know that sent me off the deep end and that was the day of our conference settlement. It got even worse as by the end of that day they had only came up to $5,000 or a one time warranty fix and my answer to them was u couldn't build it right in the first place what makes me or anyone else think u can fix it right and I said the $5,000 was an insult.
I'm not sure I'm allowed to say yet or maybe ever what we actually settled on but it was much more then $5,000!!!

I just wish folks would stop buying trackers....

they are supporting an evil empire.

the boats are garbage. (some folks use them at small cottage lakes and say "hey, they are great boats"...)

but as long as people don't want to "pay to play", trackers / nitro's will be sold.

the sales folks at the bps I was at specifically targetted "first time" boaters who didn't know any better. I walked past the boats, and they asked if I was a boat owner...I said yep, a Lund....they just said "must be nice to be rich and overpay"....

normally I'd jump all over them (stupid, uninformed salesman), but didn't have time....

How many new boaters buy a tracker/nitro as their first boat....NO ONE buys one as their "upgrade" or second boat.

Good for you, patience pays off!
Never owned a Tracker/Nitro probably never will but wonder if its just poor craftsmanship on this brand or is there something inherently flawed with welded hulls banging on big water over time?

Don't get me wrong I'm not trying to stick up for tracker....but I think the issues are mainly with the glass boats with upper end power plants. I have heard of a few problems with the bigger aluminums, but I can't imagine a tinny under 18' and powered by less than a 90hp having the power vrs mass to cause hull failure.

Congrats on the victory btw. Can't believe the lack of pride in their product.... Kinda scary being that I've heard 90% of all boats come out of 3 factory's all owned by Merc

I believe they likely settled out of court because if they loose in a court of law anyone else with the same problem can just walk in and say me too. This sets up a recall situation which opens up another whole liability issue, what if one of their boats failed out in lake Ontario and someone drowned because of the defect in their workmanship?

We have a new Samsung fridge that freezes up monthly and have been battling them for 2 years but looks like we are SOL, they blamed the repair company they have contracted as their repair service for not being able to fix it. A fridge isn't worth the legal expenses needed to get retribution but at a $135 service call put into Samsung for each time they came here over the last 2 years, they didn't make any money on this fridge. Good on you for sticking to the battle and winning the war.
